  • Professional Services: Website Designing, Development, Maintenance, Upgradation, and Digital Consultancy.

  • Content Services: Providing Family and Motivational Quotes in both Hindi and English.

3.3. Client Project IP:

  • StatusAi transfers the Intellectual Property Rights of the final, approved design and code to the Client upon receipt of the final, full payment for the Professional Services.

  • We reserve the right to display and reference completed Client projects in Our portfolio, marketing materials, and case studies.

4. User Representations and Prohibited Activities

 

4.1. Representations: By using the Website, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Terms; (2) you are not a minor (under 18); and (3) your use of the Website will not violate any applicable law or regulation.

4.2. Prohibited Activities: You may not access or use the Website for any purpose other than that for which We make the Website available. Prohibited activities include, but are not limited to:

  • Engaging in any automated use of the system, such as using scripts to send comments or messages.

  • Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Website.

5. Professional Services, Agreements, and Payments

 

5.1. Scope of Work: All Professional Services (Web Design, Development, Consultancy) initiated via the Website are subject to a separate, mandatory written Service Agreement (SA) or Statement of Work (SOW) executed by both parties. The SOW will detail the exact deliverables, project milestones, and timeline.

5.2. Quotations and Fees: All price quotes and estimates are valid for thirty (30) days from the date of issue unless otherwise stated in writing. DigitalMindWork reserves the right to change its pricing at any time without notice, though active projects will be honoured at the agreed-upon SOW price.

5.3. Payment Terms and Non-Refundable Deposit:

  • A non-refundable minimum deposit (typically 50%) is required to commence any Professional Service project. This deposit covers initial consulting, planning, and resource allocation costs.

  • The remaining balance is due upon project completion or before the final launch/delivery of files to the Client.

  • Late payments may be subject to a late fee, as specified in the SOW.

5.4. Cancellation and Refund Policy:

  • The initial deposit is non-refundable under all circumstances, including Client cancellation, due to resources committed immediately upon agreement.

  • In the rare event that StatusAi must cancel a project, the remaining balance (less the value of work completed up to the cancellation date) will be refunded to the Client.

6. Third-Party Websites and Content

 

6.1. Third-Party Links: The Website may contain links to other websites (“Third-Party Websites”). We do not investigate, monitor, or check the accuracy, adequacy, validity, reliability, availability, or completeness of any Third-Party Websites.

6.2. Disclaimer for Third Parties: DigitalMindWork is not responsible for any transactions, products, or services offered by third parties, including vendors, and shall not be liable for any damage or loss caused by or in connection with the use of or reliance on any such third-party content.
